Judgment of the Patents County Court in Musion Systems Ltd v Activ8-3D Ltd and Simon Humphreys (Case Number PAT09050)

On 14th February 2012 the Patents County Court entered judgment in default against Activ8-3D Ltd and Simon Humphreys in the action brought against them by Musion Systems Limited for infringement of Musion’s amended UK Patent No.2,427,708.

The judgment followed the Courts earlier order striking out the defence and Counterclaim of Activ8-3D Limited and Simon Humphreys for failure to pay Musion’s costs which were thrown away by the adjournment of the trial in October 2011.

The Court has granted an injunction against Activ8-3D and Simon Humphreys restraining them from any further infringements of Musion’s amended patent and ordered an inquiry as to damages suffered by Musion by reason of the acts of infringement of Activ8-3D and Simon Humphreys. The Court also ordered Activ8-3D and Simon Humphreys to destroy any infringing products in their possession, power, custody or control and to pay Musion’s costs of the claim and counterclaim.
